The following Legal Defense Plan is available to all members of the CA FOP. The plan is outlined below:
OVERVIEW
* A Self-funded Legal Defense Plan available
only to F.O.P. groups and individual members.
* Owned and operated by the Fraternal Order of Police - Legal Plan, Inc.
* Broad Legal Defense Coverage
* Pays all reasonable and necessary attorney fees when using a Plan attorney
Plan Structure
Coverage - Subject to the terms, conditions, limitations and exclusions specified in the Plan Description, the Plan provides these coverages:
Salary Reimbursement
Option - Under the Administrative coverage,
there is a Salary Reimbursement Option, which can be taken once a suspension
has been imposed and allows a Member to choose up to 3-days actual loss-of-pay
(based on regular hourly rate) or $500.00, whichever is less. No further claims
can be made after taking the Option for that specific incident or similar incident
resulting in suspension. This Option is in lieu of legal costs for the suspension.

Legal defense or, subject to the absolute discretion of the Benefit Administrator and the Board, other appropriate legal challenge to administrative discipline, sanction or proceeding:
a. involving salary, dismissal, change of assignment, demotion, promotion, leave of absence, resignation, or other professional rights, duties or responsibilities where such discipline, sanctions or proceeding arises directly out of the Participant's activities in the scope of law enforcement employment; or
b. involving the issuance, suspension, cancellation or revocation of any credential, certification or license issued by federal, state, or local authorities, which credential the Participant is required to have in the scope of law enforcement employment;...
* Legal defense of a civil action or proceeding brought against a Participant, arising directly out of the Participant's activities in the scope of law enforcement employment; provided, coverage does not extend to counterclaims or crossclaims in actions brought by a Participant, unless the Board approves otherwise, and...
* Legal defense of a criminal action or proceeding brought against a Participant arising directly out of the Participant's activities in the scope of law enforcement employment, including grand jury proceedings.
If the participant uses a Plan attorney, reasonable and necessary legal fees for Coverages A, B, and C
are fully paid when using a Plan attorney*. When a Plan attorney is used, thee is no
deductible. Reimbursable costs are paid by the Plan up to the maximum stated in the
Plan Description.
If the Participant uses a non-Plan attorney, a $250 deductible applies. After the deductible is met,
the Plan pays legal fees up to the amounts shown below:
Coverage A: Administrative; Initial Consultation, preparation and Hearing/$9,000.
Coverage B: Civil; pleading and preparation / $9,500; Trial/ $9,500@$700 per day.
Coverage C: Criminal; Pleading Preparation /$19,000. Trial/ $9,500@$700 per day, advice and
consultation for grand jury hearing / $2,500.
Reimbursable costs are limited to $2,000. This
includes witness fees and expenses, expert fees, and expenses including consultation,
filing fees, court costs and transcript costs.
* A Plan attorney means an attorney with whom the Plan has
contracted to provide legal services, as listed by the Plan.
GROUP PARTICIPANTS
All Coverages A, B and C $197/year
(A Group is defined as the lesser of 50-active members of a Local Lodge, State Lodge,
bargaining unit or State Labor Council or 50 percent of the active law enforcement
officers in such entity.)
INDIVIDUAL PARTICIPANTS
All Coverages A, B and C $215/year
Note: All benefits, coverages, terms and conditions are governed by the
Plan Description interpretation of Plan provisions, including coverages and benefits, is
vested exclusively in the Plan's Board, in its absolute description. Plan benefits
are excess over all other valid collectible benefits and coverages. The Plan is
subrogated to all rights to recover against any person or entity and has a right of
payment from any such recovery. Attorneys paid by the plan are neither agents nor
employees of the plan. The Plan makes no recommendation or warranty, express or
implied, with respect to the skill or expertise of such attorneys, including Plan
attorneys.
